Terms and Conditions

Introduction

Welcome to TransitTag, the cutting-edge digital student ID card system designed to enhance student safety in the modern era.

1. Agreement to Terms

By using TransitTag, you agree to be bound by these Terms and Conditions, whether or not you are a registered user. Terms and conditions of this agreement apply.

2. Definitions

TransitTag refers to the digital student ID card system.

User refers to any individual who uses TransitTag, including students, parents, and school staff.

Issuer refers to the entity responsible for providing TransitTag services, including the school or educational institution.

3. Description of Service

TransitTag is a digital student ID card system developed by Numeral IoT, leveraging NFC/RFID technology, real-time tracking, instant notifications, live video streaming, and seamless integration with school operations to ensure a safe commute for students.

4. Ownership

TransitTag remains the property of Numeral IoT. Issuers are granted a non-transferable, revocable license to use TransitTag solely for its intended purposes.

5. Usage

TransitTag is intended for use by students to enhance safety during their commute to and from school. Users agree to use TransitTag in accordance with its intended purposes and any guidelines provided by the Issuer. TransitTag shall not be used for any illegal or unauthorized purpose.

6. Security

Users are responsible for maintaining the security of their TransitTag digital ID cards. This includes protecting them from loss, theft, or unauthorized access. Users must not share their TransitTag credentials with others.

7. Parental Consent

Parents or legal guardians must provide consent for their child to use TransitTag if the child is under the age of 18.

8. Privacy

TransitTag respects the privacy of users and complies with all relevant data protection laws including but not limited to the Data Protection Act and its regulations and the General Data Protection Rules (GDPR). Personal information collected through TransitTag will only be used for purposes outlined in the Privacy Policy, available on the TransitTag website.

9. Data Collection and Usage

TransitTag utilizes Near Field Communication/Radio Frequency Identification (NFC/RFID) technology, real-time tracking, instant notifications, and live video streaming to enhance student safety. Data collected by TransitTag, including location information and video footage, may be used for safety and security purposes, as well as for improving the TransitTag system. Please review our Privacy Policy to understand how we collect, use, and disclose information about you.

10. Liabilities

TransitTag and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of TransitTag. The Issuer is not liable for any misuse, loss, or damage to TransitTag digital ID cards. Users are responsible for any consequences resulting from their use of TransitTag.

11. Termination

The Issuer reserves the right to revoke or terminate access to TransitTag at any time, without prior notice, for violation of these terms and conditions or for any other reason deemed appropriate by the user. TransitTag reserves the right to suspend or terminate your access to TransitTag at any time, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms and Conditions.

12. Updates and Modifications

The Issuer may update or modify these terms and conditions at any time. Users will be notified of any changes, and continued use of TransitTag constitutes acceptance of the revised terms and conditions.

13. Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of the Republic of Kenya.

14. Dispute Resolution

Any disputes arising out of or in connection with TransitTag shall be resolved by mutual negotiation to be commenced by the delivery of a written notice by one party to the other that a Dispute has arisen (Notice). If the Dispute cannot be settled within seven (7) days from the date of delivery of the Notice, the aggrieved party shall be at liberty to pursue its remedies in court.

15. Acceptance

By using TransitTag, you acknowledge that you have read, understood, and agree to abide by these terms and conditions. If you do not agree with any part of these terms and conditions, you must refrain from using TransitTag.
